1 Appellant, James Byron Woodard, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Murray County, Case No. CRF-75-28, for the offense of Unlawful Possession of LSD with Intent to Distribute. He was sentenced to serve ten (10) years imprisonment and a fine of Ten Thousand Dollars ($10,000). From said judgment and sentence, defendant has perfected this timely appeal.
